The FAME platform is a learning platform designed to offer free open data training courses to feminist civil society organisations working for the economic empowerment of women and LGBTQIA+ people, in order to build their capacities, adapted to their needs and constraints.
These general terms and conditions of sale and use (hereinafter the “General Terms and Conditions of Use”) are entered into between the User-ice and the association EMPOW’HER, registered with the Registre du Commerce et des Sociétés de Paris under number 910 681 022, whose registered office is located at 82 rue du Faubourg Saint-Martin, Paris – 75010 (hereinafter referred to as “Empow’Her”).

Article 1: Definitions
● The FAME consortium: the FAME consortium partners are GERES, SAWDF, WACSI, CARE, CONLACTRAHO and EMPOW’HER;
● E-learning: online learning;
● Training content: an asynchronous learning unit belonging to the training programme, defined by pedagogical objectives that inform the video capsules and the rest of its content;
● Users: members of feminist civil society organisations fighting against gender violence using the Platform;
● The Platform: the website providing asynchronous training modules and online content. The Platform is offered by the FAME project.
Article 2: Acceptance of the general terms and conditions
Use of the Platform implies the User’s full and unreserved acceptance of these General Terms and Conditions. It is therefore the responsibility of the User to read these General Terms and Conditions before registering on the Platform and each time he/she uses its services.
These General Terms and Conditions may be modified at any time by Empow’Her and the partners of the FAME consortium. The modified General Terms and Conditions are applicable to any use of the Platform made after the modification. The User is therefore invited to consult the General Conditions each time he/she visits the Platform. If the User refuses a modification to the General Terms and Conditions, he/she must no longer access the Platform and close his/her account.
The User accepts these General Terms and Conditions by clicking on the box provided for this purpose when registering on the Platform.
The User is invited to keep a copy of these General Terms and Conditions on a durable medium.
In the absence of proof to the contrary, the data recorded on the Platform constitutes proof of all contractual relations between the User and Empow’Her.
Empow’Her reserves the right to temporarily or permanently exclude a User from the Platform in the event of serious misconduct, disrespectful behaviour, or any behaviour that is detrimental to the proper functioning of the Platform. Users are reminded that use of the Platform implies compliance with certain standards of behaviour such as respect for others, good faith and courtesy.
Article 3: Registration
Registration takes place when the User logs on to the e-learning Platform, without which he or she cannot access the training modules.
Registration requires the following information:
- User’s e-mail address
- User’s surname and first name
- Organisation to which the User belongs
- The country in which the User is located
Once registered, each User has access to an account which they are free to consult.
The User is free to unsubscribe from the Platform at any time by following the procedures on the Platform. The User will then not be able to access his/her account and personal information. This information will be deleted after a period of 30 days.
The username and password provided by the User-ice are confidential, personal, non-transferable and non-transmissible. Empow’Her may under no circumstances be held liable for any fraudulent use of the User’s identifier and password. The User-ice undertakes to inform Empow’Her of any fraudulent use of the login and password as soon as it becomes aware of such use.
Article 4: The offer
The FAME consortium provides open data distance learning via training content made available online on the Platform. Training modules and materials are available and presented on the Platform.
Different types of content can be offered on the Platform: e-learning modules, training materials, guides, toolkits, online masterclasses via Zoom, etc.
Training content may be available in French, English and Spanish. The time required to complete the training modules is given as an indication only.
The FAME consortium reserves the right to modify the training content offered on the Platform, both in its general organisation and in its nature and content. The FAME consortium may provide, at the request of the User-ice, any computerised proof of registration and monitoring of the distance learning carried out.
Article 5: Course materials
The use of documents handed out during courses is subject to Articles 40 and 41 of the French Law of 11 March 1957: “Any representation or reproduction in whole or in part made without the consent of the author or his successors in title or assigns shall be unlawful”. Article 41 of the same law authorises only “copies or reproductions strictly reserved for the private use of the copier and not intended for collective use” and “analyses and short quotations, provided that the name of the author and the source are clearly indicated”.
Any representation or reproduction by any means whatsoever that does not comply with current legislation constitutes an infringement punishable under Articles 425 and 429 of the French Penal Code.
Article 6: Rules for using the Internet
Users connecting to the site declare that they are aware of and accept the characteristics and limits of the Internet.
In particular, the User acknowledges :
- That they alone are responsible for their use of the Platform;
- The user is responsible for managing and storing his/her login details and passwords, and for communicating his/her identification details under his/her own responsibility;
- That he/she is aware of the nature of the Internet (technical performance, response times for querying or consulting);
- That it is their responsibility to ensure that the technical characteristics of their device allow them to access the Platform and the virtual classes correctly;
- That it is their responsibility to take appropriate measures to protect and safeguard their own data and software from contamination by any viruses that may be circulating on the Platform.
Empow’Her undertakes to use its best efforts to ensure uninterrupted access to the Platform, except in the event of a breakdown or technical constraints related to the specific characteristics of the Internet or the User’s network. However, the User-ice acknowledges that no one can guarantee the proper functioning of the Internet network, and Empow’Her therefore does not guarantee the uninterrupted and error-free operation of the Module(s). In the event of an interruption of service by Empow’Her due to corrective maintenance, Empow’Her will make every effort to remedy the malfunction as quickly as possible.
The User agrees to inform Empow’Her of any technical malfunction as soon as possible.
Consequently, Empow’Her accepts no liability for any direct or indirect damage arising from the use of the Platform and/or the Internet and/or viruses.
Article 7: Intellectual property
All the elements of the Platform belong to the FAME consortium.
Any reproduction, representation or adaptation of the logos, textual, pictorial or video content, without this list being exhaustive, is strictly prohibited and is tantamount to counterfeiting and is liable to prosecution.
Training content is protected by copyright.
Any User guilty of infringement may have their account deleted without notice and without this deletion constituting any damage.
Any use by the User of the corporate names, trademarks and distinctive signs belonging to the FAME consortium is strictly prohibited without the Vendor’s express prior agreement.
Article 8: Liability
The User acknowledges that he/she is responsible for the use he/she makes of the training content, the application of tools and skills acquired during the training modules and virtual classes.
Any direct or indirect consequences, such as loss of funds, poor project management, loss of beneficiary commitment, etc., are not the responsibility of the FAME Consortium.
Under no circumstances may the FAME consortium be held liable for any damage, material or immaterial, consequential or otherwise, caused directly or indirectly by the services provided, or for any action taken by third parties.
Article 9: Protection of personal data
Empow’Her collects personal data in the course of providing training.
The purposes of the processing of personal data are as follows:
(i) identification of Users of the Platform;
(ii) quantitative and qualitative evaluation of the use of the Platform: number of connections, module completion rates, smooth operation of the Platform, etc. ;
(iii) measurement of monitoring indicators for donors.
The processing is based on the consent of the User wishing to access the training courses offered on the Platform.
The personal information collected by Empow’Her and the FAME consortium is recorded in a drive to which access is restricted to team members, and is mainly used for the proper management and operation of the Platform and to fill in the indicators for monitoring the training programme for donors.
The personal information collected is kept for 1 year after the end of the FAME project, which may not exceed the deadline of December 2027, unless the User has exercised one of his/her rights under the law, in accordance with the conditions set out below. These data belong to Empow’Her for the duration of the project.
The processing being administered in accordance with the provisions of Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, as amended by Law No. 2018-493 of 20 June 2018, Regulation (EU) 2016/679 of 27 April 2016 of the European Parliament and of the Council on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of Such Data (known as the “RGPD”).
The User-icee has the right to access, rectify and delete his/her data at any time by contacting Empow’Her, 82 rue du Faubourg Saint-Martin 75010 Paris, fame@empow-her.com.
In accordance with the essential requirement of security of personal data, Empow’Her undertakes, within the framework of the execution of its training courses, to take all necessary technical and organisational measures to preserve the security and confidentiality of personal data and in particular to prevent such data from being distorted, damaged, lost, diverted, corrupted, disclosed, transmitted and/or communicated to unauthorised persons.
Consequently, Empow’Her and the FAME consortium undertake to :
- Only process personal data for the purposes described above;
- Only give access to the data to Empow’Her employees and members of the FAME consortium working on the FAME project, who are authorised to process the data by virtue of their position;
- The information collected may be communicated to third parties bound to Empow’Her by contract for the performance of sub-contracted tasks necessary for the management of the training, without the User’s consent being required. It is specified that, in the context of the performance of their services, third parties have only limited access to the data and are under a contractual obligation to use it in accordance with the provisions of the applicable legislation on the protection of personal data;
- Apart from the cases set out above, Empow’Her and the FAME consortium undertake not to sell, rent, transfer or give access to third parties to the data without the prior consent of the User-ice.
Article 10: Use of Cookies
Users are informed that cookies may be stored on their computer when they visit the Platform. A cookie is a text file that does not allow the User to be identified but is used to record information relating to the User’s browsing on the Platform. The purpose of using these cookies is to carry out traffic analyses in order to improve the quality of the site.
The User may accept or refuse the installation of these cookies when browsing the Platform for the first time.
